被不起訴人韋某某，男性，1989年**月**日出生，居民身份證號(hào)碼1401051989********，漢族，中專文化程度，政治面貌：群眾，戶籍所在地：山西省太原市小店區(qū)**街**村**小區(qū)**排**號(hào)**，居住地：山西省太原市小店區(qū)**街**小區(qū)**號(hào)樓**單元**室，職業(yè)：個(gè)體經(jīng)營者。2020年7月14日因涉嫌危險(xiǎn)駕駛罪被太原市公安局取保候?qū)彙?/span>

本案由太原市公安局偵查終結(jié)，以被不起訴人韋某某涉嫌危險(xiǎn)駕駛罪，于2020年9月1日向本院移送審查起訴。

經(jīng)本院依法審查查明：

2020年7月13日0時(shí)50分許，被不起訴人韋某某醉酒后駕駛車牌號(hào)為晉A****M的白色凱迪拉克牌小型普通客車從太原市小店區(qū)**街**幼兒園附近出發(fā)途徑**街、**路駛?cè)?span style='color: rgb(0, 0, 0); font-family: "Times New Roman"; font-size: 21.3333px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: 2; text-align: justify; text-indent: 42.2667px; text-transform: none; white-space: normal; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: rgb(255, 255, 255); text-decoration-style: initial; text-decoration-color: initial; display: inline !important; float: none;'>**街，后又駕車回返，經(jīng)**街再次駛?cè)?span style='color: rgb(0, 0, 0); font-family: "Times New Roman"; font-size: 21.3333px; font-style: normal; font-variant-ligatures: normal; font-variant-caps: normal; font-weight: 400; letter-spacing: normal; orphans: 2; text-align: justify; text-indent: 42.2667px; text-transform: none; white-space: normal; widows: 2; word-spacing: 0px; -webkit-text-stroke-width: 0px; background-color: rgb(255, 255, 255); text-decoration-style: initial; text-decoration-color: initial; display: inline !important; float: none;'>**路并沿**路由北向南行駛，行駛至**路**學(xué)院路段時(shí)，被執(zhí)勤民警查獲。民警現(xiàn)場(chǎng)對(duì)其進(jìn)行呼氣式酒精檢測(cè)，測(cè)試結(jié)果為112mg/100ml。后對(duì)其血樣進(jìn)行乙醇成分檢驗(yàn)，乙醇含量為107.98mg/100ml。

本院認(rèn)為，被不起訴人韋某某實(shí)施了《中華人民共和國刑法》第一百三十三條之一規(guī)定的行為，但其犯罪情節(jié)輕微，且自愿認(rèn)罪認(rèn)罰，依據(jù)《中華人民共和國刑事訴訟法》第十五條的規(guī)定，可以從寬處理。根據(jù)《中華人民共和國刑法》第三十七條的規(guī)定，不需要判處刑罰。依據(jù)《中華人民共和國刑事訴訟法》第一百七十七條第二款的規(guī)定，決定對(duì)韋某某不起訴。

被不起訴人如不服本決定，可以自收到本決定書后七日內(nèi)向本院申訴。
